someone replied to me that they are mandating it for employees. My spouse was threatened in this manner for MONTHS and I can tell you that we filed a medical and a religious exemption. They refused the medical one from the doctor and accepted the religious. Its INSANITY what is occurring. Just know everyone, that you are better off filing a religious exemption written correctly and getting fired so you can sue their asses later, than taking these shots.

Read the opinion at the attached link. It was drafted by former Alabama AG Bill Pryor; now federal judge. Injuries incurred while complying with employer vaccine mandate constitute covered workers' compensation claim. Civil liability is also an option but requires more legal effort. This one was for small pox, but the principle still applies.
It's all well and good that one MIGHT have recourse. But injuries might not show up for years or decades. Also, the burden of proof would be on you, and that is a high hurdle. What Scooter discusses implies someone took a dose. Why would anyone take an experimental drug that carries risks of injury or death, no matter what legal protections one might have? Your job isn't of much value if you end up crippled or dead.
You may not be aware but, guess what, millions of people have already taken doses that they would not gave taken were it not for their employer's "mandate". The AG opinion cites statutory authority supported by case law. That's generally what most cases rely on. The "opinion" is just a consolidation in a tidy little package.

My brother works for one of those 3-letter agencies. He has some health issues he fears could be exacerbated if he took the vax. They've had him chasing his tail by constantly changing the forms required to request an exemption, shifting deadlines, and refusing to accept the forms when he tries to submit them.
He's multi-decade, late career. He lacks a couple of years of being able to retire. And what little bit he might get, they'll try to cheat him out of it - call his refusal to take the vax insubordination.
I hope for his sake, someone is waging a lawsuit similar to the CDC lawsuit on behalf of government employees.

I'm sorry he's in that bind. When I worked for NASA Goddard years ago we had a much maligned employees' union fire scientists, engineers and technicians. It stepped in twice to help friends who were sexually harassed and threatened with termination on flimsy grounds because they wouldn't put out. I don't know the answer to that. He's Senior Executive Service, I think it's called- senior management, equivalent to a VP in private industry. Government employee unions may not represent people like him.

The huge Corp I work for told us we have to Answer their Vaccination Status form by November 30th, even people like me who work from home 100% and have done so for 4 years. I have never even been close to one of their offices.
If we refuse to answer the Question they will log us as "unvaccinated" and they have made a point of letting us know they will share our information with the Government if they are required to (of course they will as the Government's goal is to create a huge Database).
So, I am not going to answer but I will write a letter notifying my employer that I am not going to respond as I work from home and I do not Consent to them sharing any information on me with the Government. I feel this is the best I can do at this time. I feel bad for the people who will be required to Test and pay for that every week. There is a still a federal mandate for federal contractors to be vaccinated by December 4th. I don't think the challenges to that have succeeded yet. And that does not allow for testing.
Yes, we need the federal contractor one to be suspended. Even though my husband doesn't have any federal contracts, his company is trying to lump him under that mandate. This is great news about OSHA but is there any hope for the federal one? I keep hearing pessimism about the federal one.
A PT friend working in an outpatient setting submitted a religious exemption that she spent many hours preparing (unpaid). She received a call from an attorney in another state who questioned her for 30 minutes (unpaid). Her request was denied a few weeks later, she was put on 14 day unpaid leave this week so that she can sit at home with no income which they hope will motivate her to get injected.
She has 30+ years experience, is highly specialized, worked full time treating patients since March '20, no one got sick including her, no one died and now she's dumped as she refuses experimental injections that don't work, don't last and cause many people harm with no recourse. Just one story among many.

Thanks for this info. In September I approached my PCP requesting a medical exemption due to my valid medical history. He responded quickly, admitted that "this is a tough situation" and that the Board of Medicine was breathing down their necks. My experienced PCP retired in 2019, new PCP is just 2 years out of his residency and after consulting with a neurologist who does not know me (my neurologist retired in 2020), he denied my medical exemption request. Done!
I don't have the energy or desire to spend my spare time trying to find a physician who will support me. In my very blue state, it seems none of them will, they're on board with the "life-saving vaccines", even for small children who don't need them. If the state's Board of Medicine finds out an M.D. who did not "properly" examine me provides a medical exemption, they can revoke their license. If the federal mandate is issued as an Executive Order, it would be unlikely that the Supreme Court would decide to hear any case brought since they would have to strike down (or uphold) the EO. That would set a precedent and none of the current Court would be willing to do so, or at least almost none. Thomas might be willing, but I doubt any other Justice would.

A friend is nurse for Advent Health in Orlando. Not interested in taking a shot. Well, she's more than not interested. She's adamantly opposed. Advent came out yesterday with a letter that referenced Dec. 4, Jan.4, Medicare requirements, blah blah blah. Bottom line is the letter sounded like a "get a jab or else" to employees, but it was written so they "could" suspend you from Dec. 4 to Jan 4. but advised everyone to get one. The local radio guy said it was an acknowledgement/bowing to gov't but also realizing the courts and Gov. DeSantis (holding a Special Session today) may alter the course of action. It looks like another Biden Folly with private business trying to navigate. Unbelievable!
If the 6th Circuit Court, where all OSHA complaints were consolidated, doesn't promptly strike down this blatantly unconstitutional (un-authorized) attempt to consolidate power under federal agencies, our Constitutional Republic is toast; gone, done. I would expect a ruling by end of November (assuming all briefing is complete by then), concurring with the 5th Circuit ruling.

I was born in the Nation's capital and lived near it most of my life. I'm a 3rd generation Federal employee (or contractor). I've seen it with my own eyes. I know whereof I speak.
As a simple thought experiment: merely consider the growth of the Federal government over many decades. Look at all the new agencies that were created or expanded. Or look at even one issue they were supposedly created to address. Did they really have a positive impact on the problem? Often, no. Yet somehow, long ago, our nation got along just fine without the Department of X! At the root, 99% of government is in function just a jobs program and wealth redistribution. For a large fraction of the nation, and the world even, the citizenry would literally be better off if large fractions of governments literally vanished as if they'd never existed.

As a Health Care worker, I will still be given the axe bc the Biden edict that entities receiving CMS/Medicare/Medicaid payments must have all people vaccinated is not affected by the 5th Circuit stay. Therefore, thousands of doctors, nurses, surgical techs, janitors, and anyone working at a facility receiving CMS payments will be fired or prevented from working there. It’s absurd, particularly since being vaxed provides no benefit for catching and transmitting CoVid. Furthermore, as is well known by many, hospitals are already short staffed. How does firing healthcare providers benefit any aspect of healthcare????

I'm wondering if the military is seeing the kind of heart problems as the sports world with the stinking vaccines. Our youngest vaxxed by Army in spring, then went through Ranger school in the heat of Georgia summer, then Airborne. I was literally worried sick over him but no trouble. Yet. I made him promise no boosters.
I am also an employee for a federal contractor. They pushed the deadline for the second dose to Jan 4. They keep sending out emails letting people know they can apply for exemptions but then I hear they are denying them left and right. I just started this job 4 months ago after a layoff. I feel like walking but just having gone through job search hell I'm not looking forward to repeating it (and I may just end up back in the same situation). Oh, and I'm a remote employee and have never met a single co-worker in the flesh.
Don't quit. Make them terminate you. Only if you are fired do you have a potential legal case of discrimination. Medical reasons? Religious exemptions? Where are the attorneys on these issues? Google “petition for review of osha vaccine mandate.” You will find the actual document filed in the 5th circuit case and at the end there is a list of all the lawyers. Some of them are private and have their addresses, phone numbers, and some email addresses. They might be able to refer you. Good luck!
It almost seems like a vaccine sales quota contest among government leaders around the world. See who can persuade, coerce, or punish the most people into taking the shot. Nobody cares if it kills or cripples the people taking it, or whether it prevents disease. Just get a needle in every arm and two in every eye, if possible, and win the big prize. Whatever that is.

If I were placing a bet in Vegas today, I would say no. It seems to me like there are three (or four) legal silos with no overlap (but I'm not a lawyer): (1) an executive order for federal government employees, (2) an executive order for companies that are in contract with the federal government, (3) OSHA for private businesses, and (4) [an executive order (signed on Biden's first day in office?)] for hospitals and nursing homes to continue to keep their eligibility for Medicaid/Medicare claims
I’m a layer but I have little to no experience in any of this. I would say (1) at will federal employees have to comply, but they should be able to get religious or medical/disability exemptions. I would go with disability exemptions because the standards as so much easier to meet than the “medical” exemptions as outlined by the CDC. For a disability exemption, all you need is a doctor to say that because of your disability, you cannot have the shot. An employer isn’t even allowed to ask what your disability is. The employer must “accommodate” you and that could mean masking and testing, but if they imposed those conditions, I would point out that the jabbed can also get and transmit the virus, so if they make only unjabbed test and mask, that is disability discrimination. (2) federal contractors should have a contract! I don’t see how Biden by EO can change the terms of a contract, but could prevent the company from getting future contracts. (3) OSHA is on very shaky grounds especially with an emergency standard. What’s the big emergency all of a sudden? And the so called emergency can wait till early next January? They could have started imposing mask and testing requirements over a year ago before there even was a jab, but they didn’t. OSHA’s going to lose the lawsuit, that’s my prediction. There also should be an exemption for people who work from home, as well as religious and medical/disability accommodations. (4) The CMS mandate (for healthcare providers that take Medicare or Medicaid), that one I don’t know about. Employees who work from home or have no contact with patients should be exempt, as well as people who already had the virus and can show current immunity.
I'm no lawyer, but the government has long history of overriding private contracts. Whether these were "legal" or not I leave to others. A recent example is the CDC suspending evictions. Remarkable that a medical bureaucracy has authority over landlord-tenant law.
Problem is many companies already have enacted policies with deadlines well In advance of the Dec and Jan deadlines, and folks have lost their jobs,
are still about to lose their jobs, or relented and got vaxxed, as a result. Is there immediate recourse for them? That would be helpful for them to know where to turn right now.
I personally do not think this is over. The 6th Circuit is supposed to hear the case. Mostly likely, it will rule as the 5th did. However, if it does not, it will go to SCOTUS.

Alex - The court left the Gov't contractor rule alone - which means that any companies that do business w the Federal Gov't still have to live by the mandate. The Gov't contractor rule is much stricter than the OSHA rule - for example OSHA exempted "Work From Home" employees from the mandate but the Gov't contractor ruling says that "WFH" must comply with vaccine or be separated on the original schedule. This train is running down the track and it does not look like it will be challenged.

My employer sells to VA Hospitals, so we're considered a government contractor or subcontractor. We were informed that even though the deadline has been extended to Jan 4, 2022, they are asking all employees to upload their proof of vaccination before the holidays (by Dec 8, 2021). Their statement regarding those that do not upload their proof is "For employees who have not uploaded their proof of vaccination by the deadline, it is likely that their ability to be employees will be impacted" Isn't that a sweet way to put it?

This is about a Federal mandate. My understanding it states could mandate a vaccine. Depends on your state's laws, whether there is actually an emergency in place, etc, etc. IMO there is no emergency, if there was one, it ended long ago and needs to be attacked as it appears to be the basis for all these mandates.

Biden may be weary of possibly creating bad law for any future executive orders or mandates. The 6th court of appeals got the MDL for these types of cases and it's a right leaning panel of Judges. Biden may know the 6th will issue bad ruling against them and they'll have to appeal to SCOTUS where they will get final ruling. For Biden, it may be better to have a threat of an OSHA action as opposed to having an OSHA invalidated by Courts.
I would hope and pray that they will "rescind" the mandates rather than have the Court shoot them down. The Dems would hate to give GOP or De Santis a win.

I work for medical provider and all employees are required to have the vaccine with no alternative such as weekly testing. This is a mandate in order to receive CMS funds as a majority of our patients have Medicare/Medicaid. I am vaccinated but don’t agree with any mandates.
Addendum: as you may know, the vaccine deadline was Jan. 4, 2022. However, the rule also required companies to have rules for implementation in place “by Dec. 5” (a Sunday), leading many companies to set a Dec. 4 deadline for employees to agree to be vaccinated. Sorry if that was unclear.

Read the opinion at the attached link. It was drafted by former Alabama AG Bill Pryor; now federal judge. Injuries incurred while complying with employer vaccine mandate constitute covered workers' compensation claim. Civil liability is also an option but requires more legal effort. This one was for small pox, but the principle still applies.

It's all well and good that one MIGHT have recourse. But injuries might not show up for years or decades. Also, the burden of proof would be on you, and that is a high hurdle. What Scooter discusses implies someone took a dose. Why would anyone take an experimental drug that carries risks of injury or death, no matter what legal protections one might have? Your job isn't of much value if you end up crippled or dead.
You may not be aware but, guess what, millions of people have already taken doses that they would not gave taken were it not for their employer's "mandate". Scooter isn't implying anything; this is a well known fact. If you want to pay for their litigation should they suffer injury, go ahead. I'm just sharing a little-known legal fact that could help some people.

My brother works for one of those 3-letter agencies. He has some health issues he fears could be exacerbated if he took the vax. They've had him chasing his tail by constantly changing the forms required to request an exemption, shifting deadlines, and refusing to accept the forms when he tries to submit them.
He's multi-decade, late career. He lacks a couple of years of being able to retire. And what little bit he might get, they'll try to cheat him out of it - call his refusal to take the vax insubordination.
I hope for his sake, someone is waging a lawsuit similar to the CDC lawsuit on behalf of government employees.

It stepped in twice to help friends who were sexually harassed and threatened with termination on flimsy grounds because they wouldn't put out. The huge Corp I work for told us we have to Answer their Vaccination Status form by November 30th, even people like me who work from home 100% and have done so for 4 years. I have never even been close to one of their offices.
If we refuse to answer the Question they will log us as "unvaccinated" and they have made a point of letting us know they will share our information with the Government if they are required to (of course they will as the Government's goal is to create a huge Database).
So, I am not going to answer but I will write a letter notifying my employer that I am not going to respond as I work from home and I do not Consent to them sharing any information on me with the Government. I feel this is the best I can do at this time. I feel bad for the people who will be required to Test and pay for that every week. I think private companies can make rules. I think you should ask your company if it will be liable for any negative reaction to the vaxx and any long term health consequences from the vaxx. If they will put that in writing (LOL)??? Bet that stops them as no longer covered by "mandate".
There is a still a federal mandate for federal contractors to be vaccinated by December 4th. I don't think the challenges to that have succeeded yet. And that does not allow for testing.

I tried getting them to do an injection in our state and they didn't respond.
A PT friend working in an outpatient setting submitted a religious exemption that she spent many hours preparing (unpaid). She received a call from an attorney in another state who questioned her for 30 minutes (unpaid). Her request was denied a few weeks later, she was put on 14 day unpaid leave this week so that she can sit at home with no income which they hope will motivate her to get injected.
She has 30+ years experience, is highly specialized, worked full time treating patients since March '20, no one got sick including her, no one died and now she's dumped as she refuses experimental injections that don't work, don't last and cause many people harm with no recourse. Just one story among many.
Still not sure if I'll be sacked from my remote healthcare job for an employer under a federal contract.
my advice, do NOT have an interview in person or on zoom. Only do it via email. They are LOOKING for a way to destroy her exemption!!!

Thanks for this info. In September I approached my PCP requesting a medical exemption due to my valid medical history. He responded quickly, admitted that "this is a tough situation" and that the Board of Medicine was breathing down their necks. My experienced PCP retired in 2019, new PCP is just 2 years out of his residency and after consulting with a neurologist who does not know me (my neurologist retired in 2020), he denied my medical exemption request. Done!
I don't have the energy or desire to spend my spare time trying to find a physician who will support me. In my very blue state, it seems none of them will, they're on board with the "life-saving vaccines", even for small children who don't need them. Gotta save Grandma, who even if she lives to be 101, will be coded as a Covid death. So the announcers on NPR can declare in hushed tones: "Eight hundred thousand Americans are dead.....".
If the state's Board of Medicine finds out an M.D. who did not "properly" examine me provides a medical exemption, they can revoke their license. If the federal mandate is issued as an Executive Order, it would be unlikely that the Supreme Court would decide to hear any case brought since they would have to strike down (or uphold) the EO. That would set a precedent and none of the current Court would be willing to do so, or at least almost none. Thomas might be willing, but I doubt any other Justice would.

A friend is nurse for Advent Health in Orlando. Not interested in taking a shot. Well, she's more than not interested. She's adamantly opposed. Advent came out yesterday with a letter that referenced Dec. 4, Jan.4, Medicare requirements, blah blah blah. Bottom line is the letter sounded like a "get a jab or else" to employees, but it was written so they "could" suspend you from Dec. 4 to Jan 4. but advised everyone to get one. The local radio guy said it was an acknowledgement/bowing to gov't but also realizing the courts and Gov. DeSantis (holding a Special Session today) may alter the course of action. It looks like another Biden Folly with private business trying to navigate. Unbelievable!
If the 6th Circuit Court, where all OSHA complaints were consolidated, doesn't promptly strike down this blatantly unconstitutional (un-authorized) attempt to consolidate power under federal agencies, our Constitutional Republic is toast; gone, done. I would expect a ruling by end of November (assuming all briefing is complete by then), concurring with the 5th Circuit ruling.

Given the intelligence community's performance over past decades, I would say "yes." The USA might literally be better off its budget and staff were reduced 90%. This same critique well applies to many government functions.
And I only partly agree: the Federal government is the biggest collection of mediocre, protected drones the world has ever known. To turn your words around, some competent people may remain but they are very much the minority. The issue is largely the same in any large organization, both government or corporate.
I was born in the Nation's capital and lived near it most of my life. I'm a 3rd generation Federal employee (or contractor). I've seen it with my own eyes. I know whereof I speak.
As a simple thought experiment: merely consider the growth of the Federal government over many decades. Look at all the new agencies that were created or expanded. Or look at even one issue they were supposedly created to address. Did they really have a positive impact on the problem? Often, no. Yet somehow, long ago, our nation got along just fine without the Department of X! At the root, 99% of government is in function just a jobs program and wealth redistribution. For a large fraction of the nation, and the world even, the citizenry would literally be better off if large fractions of governments literally vanished as if they'd never existed.

As a Health Care worker, I will still be given the axe bc the Biden edict that entities receiving CMS/Medicare/Medicaid payments must have all people vaccinated is not affected by the 5th Circuit stay. Therefore, thousands of doctors, nurses, surgical techs, janitors, and anyone working at a facility receiving CMS payments will be fired or prevented from working there. I am also an employee for a federal contractor. They pushed the deadline for the second dose to Jan 4. They keep sending out emails letting people know they can apply for exemptions but then I hear they are denying them left and right. I just started this job 4 months ago after a layoff. I feel like walking but just having gone through job search hell I'm not looking forward to repeating it (and I may just end up back in the same situation). Oh, and I'm a remote employee and have never met a single co-worker in the flesh.
Don't quit. Make them terminate you. Only if you are fired do you have a potential legal case of discrimination. Medical reasons? Religious exemptions? Where are the attorneys on these issues? If I were placing a bet in Vegas today, I would say no. It seems to me like there are three (or four) legal silos with no overlap (but I'm not a lawyer): (1) an executive order for federal government employees, (2) an executive order for companies that are in contract with the federal government, (3) OSHA for private businesses, and (4) [an executive order (signed on Biden's first day in office?)] for hospitals and nursing homes to continue to keep their eligibility for Medicaid/Medicare claims
I’m a layer but I have little to no experience in any of this. I would say (1) at will federal employees have to comply, but they should be able to get religious or medical/disability exemptions. I would go with disability exemptions because the standards as so much easier to meet than the “medical” exemptions as outlined by the CDC. For a disability exemption, all you need is a doctor to say that because of your disability, you cannot have the shot. An employer isn’t even allowed to ask what your disability is. The employer must “accommodate” you and that could mean masking and testing, but if they imposed those conditions, I would point out that the jabbed can also get and transmit the virus, so if they make only unjabbed test and mask, that is disability discrimination. (2) federal contractors should have a contract! I don’t see how Biden by EO can change the terms of a contract, but could prevent the company from getting future contracts. (3) OSHA is on very shaky grounds especially with an emergency standard. What’s the big emergency all of a sudden? And the so called emergency can wait till early next January? They could have started imposing mask and testing requirements over a year ago before there even was a jab, but they didn’t. OSHA’s going to lose the lawsuit, that’s my prediction. There also should be an exemption for people who work from home, as well as religious and medical/disability accommodations. (4) The CMS mandate (for healthcare providers that take Medicare or Medicaid), that one I don’t know about. Employees who work from home or have no contact with patients should be exempt, as well as people who already had the virus and can show current immunity.
I'm no lawyer, but the government has long history of overriding private contracts. Whether these were "legal" or not I leave to others. A recent example is the CDC suspending evictions. Remarkable that a medical bureaucracy has authority over landlord-tenant law.

Problem is many companies already have enacted policies with deadlines well In advance of the Dec and Jan deadlines, and folks have lost their jobs,
are still about to lose their jobs, or relented and got vaxxed, as a result. Is there immediate recourse for them? That would be helpful for them to know where to turn right now.

I personally do not think this is over. The 6th Circuit is supposed to hear the case. Mostly likely, it will rule as the 5th did. However, if it does not, it will go to SCOTUS.
I believe Congress is supposed to issue a "disapproval" motion as well. I have not heard anything on this.

All the highly jabbed countries are seeing huge outbreaks in COVID-19. And yes, non-cv cases are now filling up hospitals. I wonder what that’s about? More people died in the vaccine group than in the placebo group in Pfizer’s trials. They just didn’t die from cv19. Heart attacks, strokes, etc. and those are just the immediate effects. Long term, who knows?
Alex - The court left the Gov't contractor rule alone - which means that any companies that do business w the Federal Gov't still have to live by the mandate. The Gov't contractor rule is much stricter than the OSHA rule - for example OSHA exempted "Work From Home" employees from the mandate but the Gov't contractor ruling says that "WFH" must comply with vaccine or be separated on the original schedule. This train is running down the track and it does not look like it will be challenged.

I used her advice, along with some help from one of Alex's September posts asking for successful exemptions, to get my religious accommodation approved. I am a govt contractor in Alabama. They are basically rubber stamping anyone who applies. Companies realize it's tough enough to find qualified people.

My employer (FIS) has already told me that as federal contractor, the Fifth Circuit decision has no impact on Brandon's Executive Order. I have requested an accommodation and have been threatened with termination on December 31st if I do not comply with the mandate for federal contractors. Marry Christmas you filthy animals!

My employer sells to VA Hospitals, so we're considered a government contractor or subcontractor. We were informed that even though the deadline has been extended to Jan 4, 2022, they are asking all employees to upload their proof of vaccination before the holidays (by Dec 8, 2021). Their statement regarding those that do not upload their proof is "For employees who have not uploaded their proof of vaccination by the deadline, it is likely that their ability to be employees will be impacted" Isn't that a sweet way to put it?
There is plenty of evidence to make one believe that this Democrat Administration does not listen to the Courts. They say one thing but they do something else.
This is about a Federal mandate. My understanding it states could mandate a vaccine. Depends on your state's laws, whether there is actually an emergency in place, etc, etc. IMO there is no emergency, if there was one, it ended long ago and needs to be attacked as it appears to be the basis for all these mandates.

I suppose that is the right of the company's owner (large privately held company)... but I'm sure that the policy was implemented at least somewhat because of this supposed mandate. I doubt they will relent as this company has become way too Woke in recent years. Odd because the multi-billionaire owner used to be a really freedom loving person. Sad.

The fact that there is no exemption for those working from home is very telling. It’s not about workplace safety, it’s just about getting more people jabbed, which the 5th circuit mentioned in their decision.

Biden may be weary of possibly creating bad law for any future executive orders or mandates. The 6th court of appeals got the MDL for these types of cases and it's a right leaning panel of Judges. Biden may know the 6th will issue bad ruling against them and they'll have to appeal to SCOTUS where they will get final ruling. For Biden, it may be better to have a threat of an OSHA action as opposed to having an OSHA invalidated by Courts.
I would hope and pray that they will "rescind" the mandates rather than have the Court shoot them down. The Dems would hate to give GOP or De Santis a win.

I work for medical provider and all employees are required to have the vaccine with no alternative such as weekly testing. This is a mandate in order to receive CMS funds as a majority of our patients have Medicare/Medicaid. I am vaccinated but don’t agree with any mandates.
