The threats to Section 230 clearly shows that the government was pressuring social media to censor information it didn't like. It's so completely clear I don't see how there's not a 9-0 ruling in Berenson's favor. But then I read Brown's comments and realize she thinks government has every right to censor, thus maybe an 8-1 ruling.
Please keep reporting on the lawsuit. It is central to the future of free speech. Without free speech, there will be no dissent that goes unpunished by the Federal Government.
Alex. You need to continue doing whatever is necessary to hold companies and government accountable for violating our Constitutional Rights. It will establish precedent if you are able to hold them accountable, so the rest of us, who do not have the resources might have a shot in the future. However, you seem to be going about it the right way and you seem to have good representation. One idea occured to me that might be of help. I believe another edge case is that of RFK Jr. that just made it through the Fifth Circuit, which also provided sound decisions in Missouri v. Biden. I wonder if there is a way that the cases can be combined on their way to the Supreme Court. Perhaps RFK Jr. and CHD would ask the court to add you to their action. This boosts you past the District Court and gets you on the way to the Supremes. Maybe your lawyer has some thoughts on this idea.
I’m rooting for you! One thing I don’t understand though: surely the most important entity harmed when speech is censored is the listener. So, in the case of censoring the controversy around the mRNA vaccines, every person who got the vaccine without full awareness of the pros and cons was harmed. I suppose it really ought to be a class action lawsuit involving everyone who got the vaccine but would not have had they known all the details (Eg me)
