Well i can tell you this:

The other side of the same coin is that when justice is blatantly not served for preferential reasons you can guarantee the other "sort" of justice.

They are walking on very dangerous ground at the highest levels as evidenced by the new "definition" of pardon.

We've entered the realm of "Minority Report" blanket pardons territory for crimes that MAY be committed...or to simply keep crimes from being investigated.

I actually never really expected justice as we will not see it for so many things in this life. God is in control and I have peace with that. But you are right Ryan, there are many with a simmering fury who will be unable to cope with these stark injustices.

Exactly. For example with the Daniel Penny trial.

At the same time, i belive it was last week, that crazy homeless dude that pushed an elderly man onto the NYC subway tracks, resulting in that mans death, has had his sentence reduced recently and will be released on some arcane law that's never been used, by the very same corrupt prosecutor that is trying to lynch Penny for doing the right thing.

Complete inversion of Penny's incident.

In fact the law is being deployed for illegality. That's a tinderbox.

I think Federal employees may also enjoy sovereign immunity in civil suits for actions arguably performed within the scope of duty. Federal tort claims act etc. Some exceptions like police brutality etc.

I rather doubt that any of these pardons are going to withstand a judicial review, not even Hunter's. You cannot pardon somebody for crimes they have not been accused or convicted of. It is not logical and it is not legal. This will be reversed.

Yes, pre-emptive pardons are valid, legal and binding. Pardons are not subject to judicial review and the power is plenary. Be careful who you elect as president.

Open pardons are a disputed constitutional question about which the Supreme Court has never ruled. The proper matter of a pardon must be a specific offense. It cannot be "anything he might have done between this time and that time."

Yep I was writing something similar. The supreme court on occasion has stated that the president's pardon power is absolute except in the case of impeachment, it's just following the constitution. Like you all have said, it's not been tried, but it may be tried soon. This is a waste of time however. President's shouldn't be preemptively pardoning people, it's not the intention although the anti-federalists predicted this would happen. Indeed be careful who we elect as president.

Now the states on the other hand are free to prosecute someone who broke state law, regardless of the federal pardon. Once again, this hasn't been tested, but state crimes are not covered in a federal pardon, only federal crimes such as gun charges or income tax. Hunter could still see jail time...

Yes, I was thinking about state charges as a means to some measure of justice here. If Hunter didn't pay his federal income taxes in an accurate, timely fashion, does anyone really think he would have done so with respect to state income taxes? Even so, for any state income tax issues not foreclosed by an applicable statute of limitations, there's still the issue of what state(s) would have jurisdiction. Delaware? California? Anybody see those states choosing to go after Hunter? I think we have to accept that he's going to get away with it ... in this life.

Biden cannot grant a prospective pardon. If any of these officials are called before a Congressional inquiry, and they are untruthful, they can then be prosecuted.

A pardon does not confirm or even imply guilt if the pardon is issued by reason of innocence. If the pardon is pre-emptive, guilt or culpability is only speculative, but innocence is presumed under the Constitution.

We all knew that Joe was going to pardon Hunter. Not great, but not unexpected and not too big a deal. Fauci's crimes are worse than Hunter's. The economy of the whole country suffered, and children's learning progress was set back years. Some even lost their lives. Please, NO, do not pardon Fauci!
