Never. EVER. Admit to having had a drop of alcohol when pulled over. EVER. All you were doing is giving them probable cause to pull you out of your car and intimidate you and to try to find additional evidence to use against you. Don’t make their job easier. Make them prove the case against you without helping them.

I agree. Say the fifth amendment says I don’t have to answer questions. I chose to remain silent. By admitting you had a beer if you blew anything other than a .00 you would have went to jail and been convicted of a DUI.

Great posts. Absolutely it's unconstitutional.

I had a similar incident.

So I got pulled over one time with friends. I had a test the next morning, so I told my friends, I would drive them, but that I'd only have two beers. Which is exactly what I did over the course of 3.5 hrs.

I went through a DUI checkpoint. And of course, I had to get out of the car to go through a field sobriety test. I passed it...well because I wasn't drunk. I even asked two police officers if I passed. They said, yes, you're obviously not drunk, but we need you to blow into a breathalyzer. I refused.

This was in CA when their were no exceptions. You had to blow or they'd take your license and take you to jail. So I spent a night in jail and had to get a cash advance on my credit card to pay bail. I defended myself in court. I received an apology letter from the Dept. of Revenue and received my license back. True story.

That didn't keep me from driving around for 3 months during the time my license was suspended...

If they say you lack standing, we know it's all total bullshit.

I've gone through several political phases in my life.

At first, in high school, I was a 'conservative' because my mother, bless her heart had a picture of Reagan and then Bush on the wall. She was very religious. I tried(but I regularly snuck off to get shit faced, I did not stay a virgin past 15 and I occasionally smoked some weed).

Then I went to college. I got inspired by Jesse Jackson's speech because the TV said it was inspiring. I took a class in college called The Isms which made me think about all of it for the first time....I bet you can't find that class on any college campus...but it was great....it compared capitalism to socialism, fascism and communism. It was a great class. We didn't talk about rights or wrongs...just about differences. It was the beginning of my thinking.

During Vet school, OK City bombing happened. Like everyone else, I though McVeigh was a nutcase and deserved to die.

When 9/11 happened, I celebrated the Patriot Act because, by then, I was a doctor and didn't break the law(except speeding...serial offender). I had nothing to hide. I didn't have to worry about warrantless searches.

I pretty much checked out of all things politics until 2016. Trump came along. He was a buffoon, but he didn't back down or apologize for stuff that needed no apology. He grew on me. I never watched The Apprentice or paid particular attention to him. But I liked him. I liked the way he talked to people. -how he tried to understand us. I voted for him. I thought Hillary would win. I remember staying up till three am that night, in awe that someone like him could win.

I watched in rage as they targeted him over and over and over again for stupid shit. I watched while his party stabbed him in the back over and over. Then COVID....I'm almost 60---I believed at first....I mean, they wouldn't do all this if it wasn't bad. But then my medical training kicked in. Things did NOT make sense. They lied over and over. They KILLED people and lied some more. They made everything Trump said, true or not, into meme fodder. I get even more pissed off.

I voted for him again.....I watched from 35 miles east of Atlanta as the ATL Dem machine cheated Biden into office with the nonexistent water main break.

Then, I did what I thought I had a right to do....I called the Sec of State and complained about the election. Nothing bad, just bitching. No threats. I should say that the Sec of State is in charge of Veterinary Licensing in Georgia. I had filed for renewal a couple weeks after the election, with my associate, who did not call and complain about the election. Her license was renewed. Mine was not...for the first time since 1996, my license was not renewed in a timely manner. I called, they blamed COVID. I believed them. A month went by.....finally called local news, who called Sec State....next day I get an email saying my license was not renewed because of a Board complaint....well huh, so I was guilty before any notice or hearing or anything.....that's not how they do it, BTW. They renewed my license that day though because I had called the news.

Then months later, armed Sec State 'investigators' came to my clinic and went through everything looking for problems. They couldn't find anything other than I didn't write a body weight down a couple of times.....that's it. Three hours of harassing my staff and myself. I still, to this day, have not been allowed to see the actual complaint....for 'privacy' reasons.

Now I get it. I had to have the boot on my neck to finally get it.......

Yeah, government is out of control.

It takes courage to stand up to the bullies in charge. Whistleblowers are the ones who go to jail now. For example a surgeon at Texas Children''s Hospital exposed illegal sex change operations occurring there and the FBI arrested the whistleblower on felony charges. In my town, employees exposed an abusive fire chief whose abuse was white-washed in a sham investigation and her accusers are now under investigation. I have evidence of violations of campaign laws by local office holders, and the county attorney refused to even accept my complaint--his office helpfully suggested I call the police if I think somebody did something wrong. So Alex, you are brave to take on the biggest bully in the schoolyard and I hope you win. Maybe then the culture of "might makes right" will wither and we can return to something closer to a sane and fair society.

One of the first things they taught us in law school was to always lie to the cops. There is no law against it. And they are only asking you because ether don’t have the proof they need or they are trying to get you to incriminate yourself. If they have the legal basis (reasonable suspicion, probable cause, etc) they won’t ask. You will be arrested. So the next time they ask you how many drinks you have had, the answer is always zero! Even if you just took 10 shots. Let them prove you wrong.

Also, thank you for what you are doing! Can’t wait for you to have your day in court and win. Keep fighting the good fight for all of us.

Has anyone gotten randomly selected by TSA at a small airport without the whirly-bird circle censor things? They sexually molest you and that is putting it tamely. It took me months to get that far with my wife when we first started dating. Someday we need to rise up and say enough is enough, but I fear after what they did to us during the Covid years only about 20% of the population even cares. The rest would gladly trade perceived safety for their freedoms.

I have a friend from Iran who gets "randomly selected" a lot.

I would speak out for him more, but I don't 100% trust him myself even though he's pretty cool for the most part.

I always opted out of that whirly-bird thing (now that I have PreCheck, they don't try to make me go through it). Got the pat down every time, but that was preferable to the whirly-bird scanner.

I also always now opt out of the facial recognition thing when you give the TSA your ID and boarding pass.

This happened to me several times. I went through the scanner and they said I needed to be patted down. I had nothing in my pockets, no belt on and no metal on my clothing. I am a 60 something grandmother, I was shocked. They asked if I wanted to go to a private room for the procedure. Being in a hurry, I said no. You are correct, it's like being molested. Then they wiped my hands with a special wipe that detects bomb residue. As I was composing myself, I looked at the screen next to the scanner, it showed a highlighted spot near one of my private parts. WTF???

Warning. It is worth reading the Dissenting Opinion by Justice Alito. The Opinion written by Amy Comey Barrett, in contrast, was trash. lies and deflection. The Opinion screamed, "There's someone over there in the weeds, off camera, with immense power over the Court." In reading Alito's Opinion, you will see that the criteria you meet were also met in Murtha v Missouri. So, do not be surprised if the judges and justices who hear your case argue that you only imagined that you had First Amendment rights and that you only dreamed you were harmed. You are still breathing and going around spreading your views... so no harm, no foul. Move along, Alex. You deserve a huge win, but you might get a pat on the back, "You blew zero point zero, move along."

Same thing happened to my daughter, 11pm, she was in a gown and high heels, driving alone. She passed as you did, but it scared her, a lot, and as those above have noted, pushed her more towards our freedom camp!

Alex, what an awful experience well described. Your description speaks to the coercive nature of government and its overreach in the name of someone's idea of a "good cause". Except that overreach undermines and destroys our basic freedoms and rights.

Your comparison of that sobriety road check to the Berenson vs. Biden case differs only as a matter of scale. By reaching 2 million people with a point of view contrary to the government's accepted views around Covid and its treatment is a step too far for the powers that be - even if it means crushing your basic freedom of speech. Please continue this critically important fight on behalf of all of us who value our basic freedoms guaranteed by the constitution and Bill or Rights.
