I too have gone to court against stupidity. I learned that stupidity can be a formidable foe, but with reason, logic, and a fairly competent judge, truth and justice can prevail. Best wishes, you are on the side of justice. If my experience is any indicator, you will find yourself on the curb outside the courthouse, with all your legal bills in hand, DISMISSED WITH PREJUDICE. Two Supreme Court cases, Twombly and Igbal, are used to circumvent legitimate Rule 8 pleading standards using "heightened pleading standards." In essence these precedent cases are used by big law firms to convince judges (wink, wink) to ignore your plausible claim. Instead, the defense firm will present their own evidence and argument and box you into an ad hoc bench trial during which you will have no discovery rights and no right to cross examine the defense. They will lie and misrepresent the facts of the case and come up with specious arguments about why your claims just do not rise to the proper level. (And Twombly, believe it or not, puts forth the idea that these suits cost wealthy corporations too much, therefore, they should not go forward on a regular "plausible claim" basis.) The good thing for you is that you may be able to afford an appeal. With really good lawyers you can argue that your Seventh Amendment right to a jury trial was violated and your due process rights were violated (as you were deprived of discovery and cross examination during the "dismissal" trial). Hopefully, your case will be the one that will go to the appellate level and put an end to the biased judiciary's epidemic of dismissals.
