6-3 and not 9-0

The horrors of a liberal Supreme Court...

Holy shit it's officially over. I don't even live in the states but I'm going to pop a bottle. Happy for you guys.

Biden Administration will never admit it, but SCOTUS just did them a huge political favor.

Annnnd cue the Class Action lawsuits against the employers who already pseudo enforced this 'rule' which was really just a press release. I hope a whole bunch of lawyers working as general counsel at these corporations have already been relieved of their position.

It's exciting to see one mandate blocked. But it doesn't stop the mandates for health care workers, federal employees, or the military. And the military isn't approving any religious exemptions. The fight isn't over yet.

Seeing the CMS one upheld worries me. And may mean that the federal contractor and federal employee mandates have a very slim chance too. I’m relieved to see the OSHA one blocked. But this is far from over when a vaccine that doesn’t stop transmission or infection can continue to be forced on people in other corners.

This will destroy an already decimated health care industry. Maybe independent practices will start popping up again.

I wish I lived in America.

Kavanaugh caved over the CMS issue.

what an ass

If SCOTUS wasn't a political joke, it would've been 9-0

Although not for federally-funded healthcare facilities. The horror continues. 😱

When will FOX quit putting the IDIOTIC Mark Siegel on?

He talks about how great "the vaccine" is. He seems not to understand the FACT there are 11+ other vaccines. Not all are MRNAs

In the USA, the Novavax vaccine has been submitted and is more traditional yet we hear nothing about that.

No way he will ever deal with vax failures, myocarditis, ADE, negative efficacy. He is an absolute MORON and has caused problems during all this trying to toe the Fauci line.

He is an embarrassment, a hack, a source of massive misinformation and seems to be a paid shill of big pharma.

So, the take-away from this ruling is that if Congress were to legislate vaccine mandates, they'd be legal. Time to start putting our congressmen under pressure to enact legislation that would prohibit the passage of such legislation.

That’s good news except that they still are upholding the mandate for healthcare workers. My significant other is an ER Doctor who has had, and recovered, from Covid and does not wish to be vaccinated.

This part is disappointing, though:

“But the conservative-majority court allowed similar requirements to stand for medical facilities that take Medicare or Medicaid payments.” (https://www.cnbc.com/2022/01/13/supreme-court-ruling-biden-covid-vaccine-mandates.html)

I wonder if there’s any recourse on this front …

The Health care workers aren't so lucky.

Yeah baby! WHO said no to booster...now SCOTUS kills OSHA overreach. Serious progress to freeing this country from the tyranny the Biden Admin has imposed on it. (6-3 good, not great, but at least finally Roberts voted the right way)

Expand full comment

This is separate from the federal contractor mandate, the one affecting me, but I don't see how any company could continue with that after this ruling.

so Healthcare workers should quit en masse. fuck them

Still wonder what fallout there will be in healthcare. I know of several nurses who have left the places they loved working.

Expand full comment

What are they going to do with all the employees they fired in November because of this Draconian measure?

Expand full comment

The mandates remain for healthcare works and federal employees and contractors…

I do not see how it ends forced vaccinations. What it does, and Roberts and Kavanaugh should be massively ashamed of themselves (those are the public words I can say, I can not write the words I really want to say) is say that the Federal Government can FORCE pretty much ANYTHING on people if the Federal Government has a hand in paying for whatever it is. Experimental vaccines? No problem say Roberts and Kavanaugh, if the Feds pay for part of whatever it is you are doing. In the future, it will be the Health Care mandate that will prove to be VERY dangerous and much mor eimportant in eroding liberties.

Unfortunately, the court did allow a separate rule to take effect requiring shots for workers in nursing homes, hospitals and other facilities that receive Medicare and Medicaid payments from the federal government.

Sadly healthcare workers are still effected by this decision.

I expected the OSHA block because it was a massive overreach and would have invited abuse of all kinds from the agencies. However, why didn't they also block it for healthcare workers? These workers were out there day after day from the beginning of the pandemic to now. They were repeatedly exposed and many have had the virus. Why mandate the vaccines now? It makes no sense.

Expand full comment

It’s still on for Healthcare workers. Get ready for more nightmare staffing situations

Expand full comment

They kept the CMS mandate, as Roberts continues his activism an caring more about the fortunes of the court than the nation it serves. And the federal employee/contractor mandate is still out there.

1 down. At least 3 to go. What about the military? Federal contractors? Doctors and nurses?

Conservatives Thomas, Alito & Gorsuch concurring.

Commies Breyer, Sotomayor & Kagan dissenting.

Blue-Light Federalists Roberts, Kavanagh & Barrett remaining silent.

Sadly, by the movement of Roberts, they let stand the healthcare mandate. This is going to go far to erode any quality of health care and is not supported by any more science than the OSHA mandate. Criminal, both, IMO.

I wonder which justices who voted against Biden in the private employer mandate turned around and voted FOR him on the health care workers. This split decision will wind up making things WORSE for quality health care.

Yeah but Doctors and Nurses and other healthcare workers got screwed. It's time for the doctors to stop being so timid and accepting. I know a lot of them who are unvaxxed and silent.

This decision highlights that if you were to program a computer with every single point in the Constitution, fed this case into it, there wouldn't be these 6-3 decisions based on feelings. There is no ambiguity in the Constitution, as much as the left wants you to believe that to be true. This decision should have been 9-0, and while any victory is sweet, activist justices are destroying this country.

We can never let fear do this again. This honestly felt like a battle for humanities future.

I don't think it is over either.

Honestly Biden should step down right now.

Yet another surreal moment and day on Terra Firma. I have been out of work since Aug 1 2020. Yeah, that's a long time. Ran out of severance pay. Ran out of unemployment. The state even tried to claw back money but I fought and won. FINALLY, after tons of applications etc a very large bank offered me a job. I chose the vax exemption. Just this afternoon after the great news I get a call from said mega large bank. Hey we were checking to see why you chose religious? I gave them my answer and mentioned the SCTOUS ruling and she goes I don't see how that is related? Umm. it has EVERYTHING to do with that. Now...even this job is in limbo. But I'm at peace because I NEVER not ONCE compromised my convictions.

My bet is that more and more healthcare professionals will stop taking Medicare and Medicaid. Good for them. Start our own network to work within.

I'll believe it is over when my employer rescinds their policy. At this time, this is still very much ongoing.

They allowed the mandates on healthcare workers.

Roberts and Kavanaugh join the CNN viewing liberals. It's a travesty.

Unvaxxed health care workers are going to be even more pissed off due to this ruling, in which they were thrown under the bus. Interesting to see what they'll do next.
